
The General Terms and Conditions (hereinafter referred to as "GTC") shall apply between the Ticket Purchaser and Lugila Kunst & Kultur GmbH (hereinafter referred to as the "Organiser") and/or the Visitor and the Organiser. By purchasing a ticket, the ticket purchaser and the visitor (hereinafter "visitor") conclude an event contract with the organiser.
With the purchase of the ticket or with entering the event area, the rights and obligations from these GTC are acknowledged.
Tickets can only be purchased in advance online sales provided by www.vivenu.de in limited numbers (3000) using the payment methods accepted by the ticket service provider. The general terms and conditions of the ticket shop apply. After conclusion of the contract, the total price must be paid within the period set by www.vivenu.de. After receipt of payment and subsequent personalisation, the tickets will be sent to the purchaser via email. In the event of late payment, the conclusion of the contract is invalid and the tickets ordered will be cancelled.
A return of tickets is generally excluded. There is no right of revocation according to § 312 g para. 2 no. 9 BGB.
The transfer or sale (if not for profit) of tickets and the associated transfer of the right to attend to a third party is permissible in principle, but due to the personalisation of the ticket can only take place by means of a transfer. The transfer is carried out by Vivenu at the request of the purchaser.
There will be no replacement if the ticket is lost.
Admission to the event area is only possible with a valid ticket. At the entrance, the ticket must be exchanged for a festival wristband, which entitles the visitor to access during the event. The wristband must be worn for the entire duration of the festival and is not transferable to third parties. Any manipulation of the band is not permitted and will lead to exclusion from the event if the band is passed on.
It is not possible to enter the event area with vehicles. Visitors may park their cars directly at the car park or camping site. Unnecessary driving on the grounds is to be avoided urgently and is also only possible within the time frames specified by the organiser. This applies in particular to the departure from the parking and camping area.
A security check will be carried out by the security personnel on site before admission to the event site. The security personnel are instructed to carry out body and bag searches of the visitors. The visitor expressly agrees to this.
The organiser reserves the right to refuse admission to the event site to visitors in individual cases. Refusal is only possible for good cause.
Important reasons are for example (so not exhaustive):
- The visitor is carrying inadmissible objects (see below 5.)
- The visitor is heavily intoxicated (by alcohol or narcotics).
- The visitor displays racist, sexist, homophobic or in any other way degrading attitudes towards other people
- The visitor disregards official or legal requirements in the context of the Covid 19 pandemic.
If admission is refused by the organiser for good cause, the ticket shall lose its validity. In this case, the ticket price will not be refunded.
The general provisions of the Youth Protection in Public Act apply. Admission is granted from the age of 18 (§ 1 para. 1 no. 4 JuSchG).
The organiser or its staff (including the security services employed) shall exercise domiciliary rights. The instructions of the organiser's staff must be followed without fail.
It is prohibited at the entire event:
- Racist, queer-hostile, sexist, ableist and other behaviour contemptuous of human rights as well as correspondingly obvious clothing and the like
- Urinating and defecating outside the designated toilets
- Stage diving, violent dancing, climbing on stages or their elements
- enter rooms and areas that are only accessible to the organiser and authorised third parties
- Consumption and sale of narcotics of all kinds
In case of non-compliance, the visitor may be expelled from the event and banned from the premises.
It is not permitted to carry the following items:
- Glass bottles
- alcoholic beverages
- Weapons or other dangerous objects
- Pyrotechnics of all kinds
- Narcotics of all kinds
The visitor may be excluded from the event if he/she carries the above-mentioned items with him/her.
Parking and camping spaces shall be allocated by the organiser's security staff. Escape and rescue routes must be kept clear of any structures at all times.
The organiser points out that some of the areas designated as camping or parking areas are meadows and/or farmland. The accessibility of these areas may be difficult/restricted due to weather conditions.
There is no surveillance of vehicles parked in camping and parking areas. The parking of vehicles or camping (with or without a vehicle) is at your own risk. Security staff will be deployed for instruction and to check access authorisations, not to guard the vehicles. The organiser's liability for damage caused by theft or damage to vehicles parked in the parking areas by third parties is fundamentally excluded.
The parking and camping instructions published on the festival website also apply; the instructions of the security staff must also be followed immediately.
The official homepage of the event shows how long the camping area will be open. Visitors must vacate the area they are using when the camping area closes. If there are still objects of the visitor on the camping area after closing, the organiser is entitled to dispose of these objects. The organiser shall not be obliged to store items that are still on the camping area after it has been closed.
Paths, facilities and all campsite equipment must be kept clean and treated with care. This also applies to the toilets, showers and washrooms provided. For hygienic reasons, waste water may only be emptied into sinks provided for this purpose.
During the event, waste must be disposed of in the rubbish bins and containers provided for this purpose and, if necessary, separated accordingly.
The operation of sound systems on campsites is permitted during daytime, associated loudspeakers are to be aligned in such a way that they do not cause noise to the surrounding visitors; the maximum volume can be limited by the police for reasons of protection of residents. The operation of sound systems is not permitted during quiet hours at night. Violations will be punished. For the purposes of these conditions, daytime is normally considered to be the period between 8:00 a.m. and 12:00 midnight. The period between 24:00 hrs and 8:00 hrs is night time.
In the event of cancellation of the event before its commencement, the Organiser:in shall refund the admission price, unless the event can be made up for at a later date or held at another reasonable venue as a substitute.
In the event that the event already in progress is cancelled for reasons of force majeure or other serious reasons (in particular due to weather conditions or on the basis of an official order or court decision), there shall be no claim to reimbursement or compensation unless the organiser can be accused of intent or gross negligence.
Any liability for consequential damages due to a postponement or cancellation of the event is excluded.
In the event of changes to the programme, which the organiser reserves the right to make at any time, or the cancellation of individual performances by individual artists, there shall be no claims whatsoever against the organiser, provided that the event is not significantly shortened as a result or takes on a completely different character.
Within the scope of this contract, the organiser shall be liable in the event of statutory or contractual liability for the compensation of damages or for the compensation of futile expenses caused by the organiser, its legal representatives or vicarious agents in the event of intent and gross negligence. In the event of a slightly negligent breach of a primary performance obligation or a secondary obligation, the breach of which jeopardises the achievement of the purpose of the contract or the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the customer could rely (hereinafter "essential secondary obligation"), the liability of the organiser shall be limited to damage typical for the contract and foreseeable at the time of conclusion of the contract. The organiser shall not be liable for the slightly negligent breach of secondary contractual obligations that do not belong to the essential secondary obligations.
The limitation of liability also extends to the personal liability of the legal representatives and vicarious agents of the organiser.
The organiser is not liable for lost or damaged items. Parking on designated parking spaces or camping on the camping site is at your own risk. The organiser is not liable for damage caused by theft or damage to vehicles parked on the parking spaces.
The organiser expressly points out that there may be particularly high volumes at the event (especially in front of loudspeakers) and that there is a risk of possible damage to health, especially hearing. However, irrespective of this, it is strongly recommended to use hearing protection, especially when staying close to the loudspeakers. Staying in the vicinity of the loudspeakers is at the visitor's own risk. It is expressly recommended to minimise the time spent in this area.
In particular, the organiser would like to point out the following:
The event site is crossed by a public road without dedicated pedestrian crossings. Visitors cross this road at their own risk. Paragraphs 1 and 2 of this regulation apply accordingly.
The following applies to all the above limitations of liability:
Claims for culpable causation of damage to life, limb or health, under the Product Liability Act, for fraudulent misrepresentation, on the basis of a guarantee of quality assumed by the organiser or for a procurement risk assumed by the organiser remain unaffected.
Photographs and video recordings may be made by the visitor for private use. The use of professional equipment and the making of recordings for commercial purposes is not permitted. It is the visitor's responsibility to respect the personal rights of third parties (especially other visitors).
The organiser and third parties commissioned by the organiser are entitled to make visual, audio and video recordings of the visitors within the framework of the events without remuneration for the persons depicted and to use them or have them used in any way and comprehensively in all known and future media, in particular for reporting in all media including the internet, on audio or video carriers as well as for advertising the festival, for sponsor acquisition and for all other business activities of the organiser and its affiliated companies. All rights may also be transferred to third parties for the above purposes.
German law shall apply exclusively.
The Organiser reserves the right to change the GTC at any time.
Should any provision of these terms and conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining agreements. Such a provision that comes closest to the intended purpose in a legally effective manner shall replace the invalid or unenforceable agreement. The same shall apply in the event of loopholes.
